Conditions of Entry
Welcome to Rowlee Wines.
Rowlee is a privately owned vineyard, winery, restaurant, event venue and hospitality destination operating from a working agricultural property.
These Conditions of Entry set out the terms upon which entry to the Property is permitted. They are designed to help protect the safety, comfort and enjoyment of visitors while preserving the integrity of our estate and supporting our legal and regulatory obligations.
By entering the Property, you acknowledge that you have had the opportunity to read these Conditions of Entry and agree to comply with them.
1. Definitions
For the purposes of these Conditions of Entry:
Rowlee means Rowlee Wines Pty Ltd, its directors, officers, employees, contractors, agents and authorised representatives.
Property means all land, vineyards, gardens, buildings, roads, car parks, pathways, fences, gates, accommodation, hospitality venues, event spaces and any other areas owned, occupied or controlled by Rowlee.
Visitor means any person entering the Property other than a Rowlee employee acting in the course of their employment, including customers, members, wedding guests, event attendees, accommodation guests, contractors, vendors, suppliers, delivery personnel and any other authorised person.
These Conditions apply to all Visitors, whether or not a booking has been made.
These Conditions operate in addition to any booking terms, event agreement, accommodation terms, membership terms or other agreement applicable to a Visitor. To the extent of any inconsistency, the terms of the specific agreement will apply.
2. Entry to Private Property
Rowlee is private property.
Entry is conditional upon compliance with these Conditions of Entry and any lawful direction provided by Rowlee staff.
Management reserves the right to:
- refuse entry;
- refuse service;
- restrict access to any part of the Property;
- require any person to leave the Property; or
- contact Police or Emergency Services where considered necessary.
Failure to comply with these Conditions of Entry may result in removal from the Property without refund, compensation or any further liability on the part of Rowlee, to the fullest extent permitted by law.
Entry onto the Property outside approved operating hours or without the permission of Rowlee may constitute trespass.
3. Compliance with Laws
Visitors must comply with all applicable Commonwealth, State and Local Government legislation together with all lawful directions issued by Rowlee staff.
This includes, but is not limited to:
- Responsible Service of Alcohol requirements;
- Work Health and Safety requirements;
- road and parking rules;
- fire safety requirements;
- emergency directions; and
- any temporary restrictions implemented to protect public safety or agricultural operations.
4. Assumption of Inherent Risks
Rowlee is a working vineyard and agricultural property where inherent risks cannot be completely eliminated.
By entering the Property, Visitors acknowledge these inherent risks and agree to exercise reasonable care for their own safety, the safety of those in their care, and the safety of Rowlee employees.
These inherent risks may include, but are not limited to:
- uneven, sloping, gravel or unstable ground;
- wet, muddy or slippery surfaces;
- stairs, retaining walls and changes in elevation;
- vineyard trellising and irrigation infrastructure;
- moving vehicles and agricultural machinery;
- tractors, forklifts and maintenance equipment;
- wildlife, insects, snakes and other animals;
- falling branches and natural vegetation;
- dust, pollen and allergens;
- changing weather conditions; and
- normal agricultural operations.
Visitors should remain alert at all times.
5. Working Vineyard and Agricultural Operations
Rowlee is an active vineyard and agricultural workplace.
Agricultural, vineyard and maintenance operations may occur at any time, whether or not the Property is open to visitors.
Activities may include:
- pruning;
- mowing;
- spraying;
- harvesting;
- machinery operation;
- deliveries; and
- maintenance works.
Visitors must:
- remain within designated public areas;
- obey all safety signage;
- comply with directions provided by Rowlee staff; and
- not enter vineyards, production areas, maintenance areas or any other restricted area unless authorised by an authorised representative of Rowlee.
6. Slips, Trips and Falls
The natural landscape forms part of the Rowlee experience.
Paths, lawns, gravel surfaces and outdoor areas may become uneven or slippery due to weather, irrigation, frost or seasonal conditions.
Visitors should wear appropriate clothing and footwear and exercise caution throughout the Property.
7. Weather Conditions
Visitors are responsible for dressing appropriately for prevailing weather conditions and for exercising their own judgement regarding personal safety in changing weather conditions.
Conditions may include:
- heat;
- cold;
- frost;
- rain;
- wind;
- storms;
- smoke; and
- reduced visibility.
For safety reasons, Rowlee may temporarily close areas of the Property, modify operations or suspend activities where weather or other environmental conditions present an unacceptable risk. Visitors must comply with all closures, safety directions and instructions issued by Rowlee staff.
8. Responsible Service of Alcohol
Rowlee complies with the Liquor Act 2007 (NSW) and Responsible Service of Alcohol requirements.
Alcohol will only be served to persons aged 18 years or older.
Management reserves the right to:
- request proof of age;
- refuse or cease service of alcohol;
- remove alcohol from any person; and
- require intoxicated or disorderly persons to leave the Property.
Visitors are encouraged to arrange safe transport if consuming alcohol.
Visitors must not bring or consume alcohol purchased or obtained from external sources on the Property unless expressly authorised by Rowlee. Any unauthorised alcohol brought onto the Property may be required to be surrendered to Rowlee staff and may be returned to the Visitor upon departure.
9. Parking and Vehicle Access
Visitors park vehicles at their own risk.
To the fullest extent permitted by law, Rowlee accepts no responsibility for loss of or damage to vehicles or their contents.
Visitors must:
- park only in designated areas;
- observe speed limits;
- exercise caution around pedestrians; and
- follow staff directions.
Unauthorised vehicles are not permitted beyond visitor parking areas.
10. Children
Children are welcome at Rowlee.
Parents and guardians remain solely responsible for supervising children at all times.
Children must not:
- enter the vineyard;
- climb vineyard infrastructure;
- enter production or maintenance areas;
- operate machinery or equipment;
- approach agricultural machinery or vehicles;
- be left unsupervised;
- enter garden beds;
- damage gardens, landscaping, furniture, buildings or other Rowlee property;
- remove gravel from pathways; or
- interfere with gravelled areas, including playing with or removing stones.
11. Dogs
Well-behaved dogs are welcome in designated outdoor areas unless otherwise advised.
Dogs must:
- remain on a secure lead at all times;
- remain under effective control;
- be cleaned up after immediately; and
- not disturb other visitors or staff.
Dogs are not permitted in food preparation areas, vineyard areas or anywhere prohibited by law.
Certified assistance animals are welcome in accordance with applicable legislation.
Rowlee reserves the right to require the immediate removal of any dog that, in Rowlee's reasonable opinion, is aggressive, disruptive, uncontrolled or presents a risk to people, animals or property.
12. Photography and Filming
Visitors are welcome to take photographs for personal, non-commercial use.
Commercial photography, filming, influencer content creation, media activity or promotional shoots require the prior written approval of Rowlee.
Photography or filming of wedding ceremonies, private events or other guests in a manner that unreasonably interferes with their enjoyment or privacy may be restricted at the discretion of Rowlee.
From time to time, Rowlee may photograph or film public areas and events for promotional and marketing purposes.
Visitors who do not wish to appear in promotional material should advise a member of the Rowlee team upon arrival.
13. Drone Operations
Recreational drone use is not permitted.
The operation of drones on or above the Property requires prior written approval from Rowlee.
Approved operators must provide:
- evidence of CASA registration where applicable;
- current Public Liability Insurance; and
- any licences or approvals required by law.
Approval may be withdrawn at any time.
14. Contractors and Commercial Operators
All contractors, suppliers and commercial operators must obtain prior approval before undertaking work on the Property.
Contractors must:
- comply with Rowlee Work Health and Safety requirements;
- maintain current Public Liability Insurance;
- provide Certificates of Currency upon request;
- comply with directions issued by Rowlee staff; and
- operate only within approved work areas.
15. Protection of Property
Visitors are expected to treat the Property with care and respect.
Any person responsible for deliberate or negligent damage to buildings, gardens, pathways, vineyards, equipment, furniture or infrastructure may be liable for the reasonable cost of repair or replacement.
16. Personal Property and Lost Property
Visitors remain responsible for their personal belongings.
To the fullest extent permitted by law, Rowlee accepts no responsibility for loss, theft or damage to personal property.
Lost property retained by Rowlee will be held for a reasonable period before being donated, disposed of or otherwise dealt with at Rowlee's discretion.
17. Limitation of Liability
Nothing in these Conditions of Entry excludes, restricts or modifies any rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
To the fullest extent permitted by law, Rowlee is not liable for any loss, damage, injury, delay, expense or inconvenience arising from:
- the inherent risks associated with entering a working vineyard and agricultural property;
- weather events;
- the acts or omissions of other visitors;
- temporary closures or restricted access;
- interruptions to services; or
- circumstances beyond Rowlee's reasonable control.
Visitors remain responsible for exercising reasonable care for their own safety and for those in their care.
18. Privacy
Personal information collected through bookings, events, memberships, accommodation, enquiries or other interactions is managed in accordance with the Privacy Act 1988 (Cth) and the Rowlee Privacy Policy.
Our Privacy Policy explains:
- what information we collect;
- how it is used;
- how it is stored;
- when it may be disclosed; and
- how visitors may access or correct their personal information.
A copy of our Privacy Policy is available on our website.
19. Emergency Procedures
In an emergency, Visitors must:
- remain calm;
- immediately follow directions provided by Rowlee staff or emergency services;
- proceed to the designated assembly area if instructed; and
- avoid entering restricted areas unless authorised.
Anyone who observes an emergency should immediately notify a member of the Rowlee team or call 000 where there is an immediate threat to life or property.
If a child, vulnerable person or member of your group becomes separated, immediately notify a Rowlee team member.
20. Biosecurity
Rowlee is a biosecure agricultural property.
Visitors must not:
- enter vineyard areas unless consent is provided by an authorised representative of Rowlee;
- bring pets into vineyard areas;
- climb vineyard trellising or irrigation systems;
- remove grapes, vines, fruit, plants, soil or agricultural material;
- introduce plant material, soil or equipment into vineyard areas without approval; or
- interfere with vineyard operations or agricultural infrastructure.
Management may temporarily restrict access to areas during spraying, harvesting, maintenance works or where biosecurity considerations require.
21. Smoke-Free Environment and Fire Safety
Smoking and vaping are permitted only in designated areas.
Visitors must not:
- light fires, fire pits, candles, sparklers, fireworks or other open flames without written approval;
- discard smoking materials outside designated receptacles; or
- undertake activities that present an unreasonable fire risk.
During periods of Total Fire Ban, Extreme Fire Danger or where otherwise considered necessary for safety, additional restrictions may apply, including a prohibition on smoking and vaping.
Anyone who observes smoke or fire should immediately notify a Rowlee team member or call 000.
22. Changes to these Conditions
Rowlee may amend these Conditions of Entry from time to time.
The current version will always be available on our website and via QR code displayed at the Property entrance.
Entry to the Property following publication of an updated version constitutes acceptance of the revised Conditions of Entry.
23. Severability
If any provision of these Conditions is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
24. Governing Law
These Conditions are governed by the laws of New South Wales, Australia.
25. Acceptance of Conditions
By entering Rowlee Wines, you acknowledge that:
- you have had the opportunity to read these Conditions of Entry;
- you understand that Rowlee is a working vineyard and agricultural property;
- you acknowledge and accept the inherent risks associated with entering the Property;
- you agree to comply with these Conditions and all lawful directions provided by Rowlee staff;
- you accept that access to parts of the Property may be restricted or altered at any time for operational, agricultural or safety reasons; and
- you enter the Property voluntarily.
